5.05.010 Haystack defined.

“Haystack” means baled hay or straw stacked in contiguous tiers as a single unit or stack. (Ord. 401 § l(part), 1975).

5.05.020 Hayloading operation defined.

“Hayloading operation” refers to loading of hay onto a truck or vehicle for conveyance away from the haystack site. The loading of hay by the owner thereof, or his agent, for movement within the confines of his property for his own use shall not be deemed to be a hayloading operation for purposes of this chapter. (Ord. 401 § 1 (part), 1975).

5.05.030 Posting required.

Each haystack located in Madera County shall be posted by its owner with a sign showing the name, address and telephone number of the owner. Signs shall be at least eleven inches by twelve inches in size and shall be legibly printed with large letters. (Ord. 401 § l(part), 1975).

5.05.040 Preparation of pick-up order.

Whoever authorizes a hay loading operation, be it the owner or the buyer of the hay, shall cause a “pick-up order” to be prepared and issued in quadruplicate, as hereinafter provided, containing the following:
1. The name and address of the owner of the haystack;
2. The name and address of any buyer or agent ordering conveyance of the hay;
3. A description of the quantity and type of hay ordered conveyed and of the location of the haystack;
4. The name and address of the hayloader who loads the hay and a description and license number of his vehicle;
5. The name and address of the driver who conveys the hay and a description and license number of his truck or other vehicle; and
6. The date and time of loading and number of bales loaded.
“Pick-up orders” shall be forms approved by the district attorney. (Ord. 401 § 1(part), 1975).

5.05.050 Issuance of pick-up order.

Before any hayloading operation occurs, one copy of the pick-up order shall be delivered to the person designated to load the hay and two copies thereof shall be transmitted to the driver of the truck or vehicle to be utilized for conveyance of the hay. Additionally, one copy of the pick-up order shall be prepared for the owner and for any buyer or agent authorizing the hayloading operation.
Persons buying baled hay from a hay dealer may in lieu of the pick-up order required by this chapter have and keep either a bill of sale, invoice, or certified weigh master’s certificate. All other requirements of this chapter shall apply to the documents used in lieu of pick-up orders. (Ord. 401 § 1(part), 1975).

5.05.060 Possession of pick-up order.

The person loading the hay and the driver of the truck upon which the hay is loaded shall each have a legible copy of the pick-up order in his possession at the time and place of each hayloading operation. The second copy of the pick-up order issued to the truck driver shall be left at the haystack site. (Ord. 401 § 1(part), 1975).

5.05.070 Retention of pick-up order.

Persons required to use or possess pick-up orders shall retain a copy of each pick-up order for a period of six months. Peace officers are hereby authorized to conduct inspections of pick-up orders either enroute or at points of departure or destination of transported hay. (Ord. 401 § 1(part), 1975).

5.05.080 Violations.

Any person violating a provision of this chapter shall be guilty of a misdemeanor. (Ord. 401 § 1(part), 1975).
