9.36.010 Manufacture of fireworks prohibited.
The manufacture of fireworks within the unincorporated area of Madera
County is prohibited except under special permits as are required by state
regulations. (Ord. 529 § 1(part), 1990).
9.36.020 Sale or use of fireworks prohibited east of Madera Canal.
Except as hereinafter provided in this chapter or as permitted in Chapter
5.16 (Outdoor Festivals), it shall be unlawful for any person to offer for sale,
expose for sale, sell at retail or use or discharge any fireworks in the
unincorporated area of Madera County east of the Madera Canal. (Ord. 529 §
1(part), 1990).
9.36.030 Permit--Issuance authority.
The fire chief shall have the authority to issue permits for the storage
and sale of such fireworks in the unincorporated area of Madera County west of
the Madera Canal under the supervision of persons to be named in such permit on
satisfactory proof that such storage, or sale is to be supervised in such a way
as to prevent undue danger to life and property. (Ord. 529 § 1(part),
1990).
9.36.040 Permit--Fee.
The fire chief shall collect a fee for storage and sale of fireworks. The
permit fee for storing such fireworks shall be one hundred dollars per year. The
permit fee for selling such fireworks shall be one hundred dollars and shall be
only for the period beginning June 15th and ending on July 10th of each year. No
such fee may be waived. (Ord. 529 § 1(part), 1990).
9.36.050 Exceptions.
Nothing in this article shall be construed to prohibit the use of
fireworks by railroads or other transportation agencies for signal purposes of
illumination, or the sale or use of blank cartridges for a show or theater, or
for signal or ceremonial purposes in athletics or sports or for use by military
organizations. (Ord. 529 § 1(part), 1990).
9.36.060 Seizure of fireworks.
The fire chief shall seize, take, remove or cause to be removed at the
expense of the owner or possessor all stocks of fireworks offered or exposed for
sale, stored or held in violation of this article. (Ord. 529 § 1(part),
1990).
9.36.070 Adoption of Uniform Fire Code, “Fireworks and Pyrotechnical Special Effects Material.”
Article 78 of the 2001 or current Uniform Fire Code, entitled
“Fireworks and Pyrotechnical Special Effects Material” is
incorporated by reference and, except as otherwise provided herein, shall govern
manufacture, sales, storage, use and disposal of fireworks. The term
“fireworks” shall mean fireworks as defined in the 2001
or
current Uniform Fire Code. (Ord. 529A § 2, 2002: Ord. 529 §
1(part), 1990).
9.36.080 Penalties.
Violation of any provision of this chapter is a misdemeanor. (Ord. 529
§ 1(part), 1990).
