10.08.100 Violation--Penalty.

10.08.010 Streets designated.

A. The streets designated in subsection C of this section are declared to be “truck traffic routes” for the movement of vehicles exceeding a maximum gross weight of three tons, or six thousand pounds, within the designated areas of the county set forth on that certain map, a copy of which is on file in the office of the county clerk-recorder.
B. The road commissioner of the county is authorized and directed to designate such streets by appropriate signs as truck routes.
C. Area No. 1 as designated on the map on file in the office of the county clerk-recorder:
1. Madera Avenue;
2. Avenue 13.

10.08.020 Excess weight prohibited on certain streets.

A. No person shall operate any truck having a gross weight in excess of three tons on any street within the designated area in the county as herein described and set forth on the map referred to in Section 10.08.010, except on those streets specified for such designated area in Section 10.08.010, and further except as hereinafter provided in this chapter. For the purposes of this chapter, “truck” includes the words “truck and trailer, or any combination thereof” and “any commercial vehicle” as defined by the Vehicle Code of the state.
B. Except as otherwise provided in this chapter, no person shall operate any truck having a gross weight in excess of seven tons on any of the following described streets:
1. Avenue 10 1/2;
2. Lanes Bridge Drive;
3. Avenue 11;
4. Fig Grove Road;
5. Rolling Hills Drive;
6. Road 432;
7. Indian Lakes Estates subdivision, consisting of:
Road 417 East of Quartz Mountain Road (Picayune Road), Modoc Road, Modoc Court, Cheyenne Road, Oneida Avenue, Ottawa Avenue, Chinook Road, Navajo Avenue, Navajo Court, Huron Road, Huron Court, Seminole Avenue, Sioux Road, Erie Road, Delaware Road, Delaware Court, Crow Road, Cherokee Road, Comanche Road, Klamath Avenue, Miwoc Avenue, Apache Road, Apache Court, Blackfoot Road, Blackfoot Court, Hopi Avenue, Chickasaw Road, Shawnee Avenue.
The road commissioner of the county is authorized and directed to post appropriate signs on and about the above-designated streets and roads giving notice of the weight restriction provided by this subsection.
C. Alternate routes for the designated streets and roads in subsection B of this section are as follows:
1. Avenue 10 and Business Highway 41 are alternate routes for the streets and roads designated in subsections (B)(1) through (B)(5).
2. Road 274 is an alternate route for Road 432 designated in subsection (B)(6). (Ord. 273F § 2, 2004; Ord. 273-E §§ 1 and 2, 2002; Ord. 273D § 1, 1995: Ord. 273 § 2, 1963).

10.08.030 Operation provisions.

Subject to the rules and regulations established herein pertaining to truck routes, truck traffic may be allowed in the hereinabove designated area of the county:
A. Truck Traffic Inside Designated Area; Outside Origin.
1. Outside destination: All trucks entering said designated area for a destination point outside said designated area shall operate only over a truck route as hereinbefore established.
2. One inside destination point: All trucks entering said designated area for a destination point in the designated area shall enter the designated area only on an established truck route and shall proceed only over an established truck route and shall deviate only at the intersection with the street nearest to the destination point. Upon leaving the destination point the deviating truck shall return to the nearest truck route by the shortest route.
3. Multiple inside destination points: All trucks entering said designated area for multiple destination points shall enter the designated area only on established truck routes, shall proceed only over established truck routes and shall deviate only at the intersection with the street nearest to the first destination point. Upon leaving the first destination point, a deviating truck shall proceed to all other destination points by the shortest route. Upon leaving the last destination point, the deviating truck shall return to the nearest truck route by the shortest route.
B. Truck Traffic Inside Designated Area; Inside Origin.
1. Outside destination point: All trucks on a trip originating in the designated area and traveling in the designated area for a destination point outside the designated area shall proceed by the shortest route to the nearest truck route as herein established.
2. Inside destination points: All trucks on a trip originating in said designated area for destination points in the designated area shall proceed to such destination points by the shortest route. (Ord. 273 § 3, 1963).

10.08.040 Point of destination exclusion.

The term “point of destination” as used in this chapter does not include a place or point of stoppage for the purpose of parking, storing or repairing of such trucks or vehicles. (Ord. 273 § 4, 1963).

10.08.050 Point of origin exclusion.

The term “point of origin” as used in this chapter shall not include any place or point wherein the truck is parked, stored or repaired. (Ord. 273 § 5, 1963).

10.08.060 Certain delivery or pickup trucks exempted.

Nothing in this chapter shall be construed as applying to any truck coming from an unrestricted street having ingress and egress by direct route to and from streets on which traffic is restricted as herein provided when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on streets other than truck routes, or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon a street other than a truck route for which a building permit has previously been obtained, or to any vehicle owned by a public utility while necessarily in use in the construction, installation or repair of any public utility, or to any vehicle which is subject to the provisions of Section 50-1/4 of the Public Utilities Act, or to any vehicle owned or operated by the county while engaged in repair, maintenance or construction of streets, street improvements or street utilities. 10.08.070 Refuse or garbage truck exemption.

The provisions of this chapter shall not apply to refuse or garbage trucks and equipment used in the collection of refuse or garbage in the areas herein designated, which are engaged in such operation pursuant to a franchise or permit issued by the county for the collection of such refuse and garbage. 10.08.080 School bus exemption.

The provisions of this chapter shall not apply to any and all school buses operated by a school district in the areas herein designated. (Ord. 273-B § 1, 1964: Ord. 273 § 6.2, 1963).

10.08.090 Authority to have trucks weighed.

Any police officer shall have the authority to require any person driving or in control of any truck on any public street or highway in a designated area of the county to proceed to any public or private scale available for the purpose of weighing and determining whether this chapter has been complied with. (Ord. 273 § 7, 1963).

10.08.100 Violation--Penalty.

The penalty for violations of this chapter shall be as prescribed in Chapter 1.12 of this code. (Ord. 378 § 2(part), 1973: Ord. 273 § 8, 1963).
