10.24.010 Definitions.
A. “County highway,” as used in this chapter, means any
roadway or public thoroughfare which is surveyed, engineered, designed or
constructed by the county; surveyed, engineered, designed or constructed by
others and dedicated to the county (whether such offer of dedication is accepted
or not); and any roadway or public thoroughfare that is otherwise acquired by
the county.
B. “County highway” includes the entire right-of-way
of the county regardless of whether the entire right-of-way is actually used for
purposes of public travel. (Ord. 459-B § 1 (part), 1990).
10.24.020 Obstructions prohibited.
It is unlawful for any person, including the owner of any of the following
described items, or the employer or any other person employing or otherwise
directing the conduct of any other person, to do, direct, cause, order or permit
to be done any of the following upon any county highway unless prior written
authorization from the road commissioner is obtained:
A. Divert, drain,
sprinkle or otherwise cause to allow water, silt, mud or debris to flow or seep
onto, into or under any county highway;
B. Place, store or allow the
accumulation of fertilizer, manure or any type of soil additive or supplement on
any county highway;
C. Place or burn agricultural waste, clippings or
prunings on any county highway;
D. Construct or install permanent or
temporary fences on or across any county highway;
E. Place, store, throw,
sweep, deposit or permit the escape of any debris, mud, manure, garbage, refuse,
carcasses of dead animals, or nauseous or offensive matter, on or under any
county highway;
F. Park or place any vehicle or any implement of agriculture
or husbandry on any county highway which is likely to injure or create a risk of
injury to any person, create a traffic hazard or impede maintenance of or travel
on any county highway;
G. Disk, cultivate, level or ditch any county
highway;
H. Plant any vineyard, orchard, field crop, or any ornamental
flowers, trees or shrubbery on or across any county highway;
I. Keep or
allow livestock on any county highway;
J. Place or store any material or
commodity on any county highway, including but not limited to building material,
beehives, pallets, hay, cotton bales or modules, garbage bins, agricultural
gondolas, storage tanks, or the like;
K. Use any county highway for loading
or unloading trucks, trailers or any other vehicle or any implement of
agriculture or husbandry;
L. Construct or place any type of permanent or
temporary irrigation system or tailwater holding pond upon, under, across or
within any county highway;
M. Use any county highway to park or store any
vehicles, any implements of husbandry, or any commodities used or owned by
adjacent private businesses. (Ord. 459-B § 1 (part), 1990).
10.24.030 Field operations.
It is unlawful for any person, including the owner or any other person
employing or otherwise directing any driver or operator of any of the following
identified machinery to do, direct, cause, order or permit to be operated any
vehicle or any implement of husbandry or agriculture, including, but not limited
to, forklifts, manure spreader trucks, grape harvesters, cotton harvesters,
tractors, track layers, plows, disks, rippers, trailers, planes or the like on,
over or across any county highway during any field operation or to turn any such
vehicle around on any county road; provided that such implements may travel upon
the paved portion of a county highway as permitted by the California Vehicle
Code. (Ord. 459-B § 1 (part), 1990).
10.24.040 Access roads.
No road accessing onto a county highway shall be constructed without a
prior, written permit from the road commissioner. The road commissioner shall
set specifications for such access roads in the permit. (Ord. 459-B §
1(part), 1990).
10.24.050 Violations.
Any violation of the provisions of this chapter shall be punished as
provided by Chapter 1.12. (Ord. 459-B § 1(part), 1990).
