13.60.010 Regulations.

The director, with the approval of the board of supervisors, shall establish uniform rules and regulations and requirements not in conflict with this article or the laws of the state relating to the construction, installation, alteration, modification, location, and dimensions of sewage facilities, based upon investigation, inspection and tests or accepted sanitation standards in order to provide wholesome and sanitary conditions within the unincorporated territories of the county. 13.60.020 Application.

Any person desiring to secure a permit or approval as required by this article shall file an application therefor with the department, on such forms as the department shall require. The application shall contain a detailed plan and description of the existing or proposed means for the disposal of sewage and/or any proposed addition or alteration. The application shall also contain such other information as the director shall prescribe. The department may investigate the proposed sewage disposal system and the conditions affecting it to determine whether the construction as proposed will be injurious to the health of, or offensive to other members of the community. The department must grant, conditionally grant, or deny an application for a permit after appropriate investigation of all factors involved. (Ord. 279 § 46, 1963).

13.60.030 Permits.

A permit from the health department shall be obtained prior to initiation of construction of any type of sewage facility. All provisions as so stated in the permit shall be complied with. Any deviation from the provisions shall require prior approval by the director. The permit is not transferable. (Ord. 279 § 47, 1963).

13.60.040 Additional conditions for permits--Aerobic systems.

A. In those areas within the unincorporated territory of the county where individual aerobic wastewater treatment units are required, in addition to the requirements of 13.60.020 it shall be an additional condition for issuance of a permit for construction of such units that the applicant furnish satisfactory proof to the Madera County environmental health department that the system design and construction, materials and performance meet the treatment standards set forth in the current National Sanitation Foundation Standard Number 40 or its equivalent for individual aerobic wastewater treatment plants and that the applicant will provide warranties, service policies, parts, service, an owner’s manual and service label as set forth in Section 7 of Standard Number 40.
B. Aerobic wastewater treatment systems which are currently approved within the county of Madera are exempt from the provisions of Section 13.60.040 until June 30, 1988. (Ord. 279C/232A §§ l, 2, 1987).
