17.70.010 Authority of county surveyor to make official map.
Whenever any subdivision of land is plotted or divided into lots by
blocks, and whenever any addition to any subdivision is laid out into lots or
blocks for the purpose of sale or transfer, the county surveyor, under the
direction and with the approval of the board of supervisors, may make an
official map of the town or subdivision, giving to each block on the map a
number, and to each lot or subdivision in the block a separate number or letter,
and giving names to the streets, avenues, lanes, courts, commons or parks, as
may be delineated on the official map. (Ord. 278N § 15(part),
2004).
17.70.020 Procedure.
Any surveyor or engineer, licensed in the state of California, under the
review of the county surveyor may prepare an official map to be filed for record
pursuant to subdivisions (D) and (E) of Section 66499.35 of the California
Government Code. The map shall be prepared in accordance with the following map
format specifications:
A. It shall be legibly drawn, printed or reproduced
by process guaranteeing a permanent record in black on tracing cloth or
polyester base film. Certificates, affidavits and acknowledgments may be
legibly stamped or printed upon the map with opaque ink. If ink is used on
polyester base film, the ink surface shall be coated with a suitable substance
to assure permanent legibility.
B. The size of each sheet shall be eighteen
by twenty-six inches. A marginal line shall be drawn completely around each
sheet leaving an entirely blank margin of one inch. The scale of the map shall
be large enough to show all details clearly and enough sheets shall be used to
accomplish this end. The particular number of the sheets and the total number
of sheets comprising the map shall be stated on each of the sheets, and its
relation to each adjoining sheet shall be clearly shown.
C. All survey and
mathematical information and data necessary to locate all monuments and to
locate and retrace any and all interior and exterior boundary lines appearing
there shall be shown, including bearings and distances of straight lines, in
radii and arc length or chord bearing and length for all curbs, and any
information which may be necessary to determine the location of the centers of
curbs and ties to existing monuments used to establish the subdivision
boundaries.
D. Each parcel shall be numbered and each block may be numbered
or lettered. Each street shall be named or otherwise designated.
E. The
exterior boundary of the land included within the subdivision shall be indicated
by distinctive symbols and clearly so designated. The map shall show the
definite location of the subdivision, and particularly its relation to
surrounding surveys.
If the map includes a “designated
remainder” parcel, and the gross area of the “designated
remainder” parcel or similar parcel is five acres or more, that remainder
parcel need not be shown on the map and its location need not be indicated as a
matter of survey, but only by deed reference to the existing boundaries of the
remainder parcel.
A parcel designated as “not a part” shall be
deemed to be a “designated remainder” for purposes of this
section.
F. On or after January 1, 1987, no additional requirements shall be
included which do not affect record title interests. However, the map shall
contain a notation or reference to additional information required under the
provisions of Title 17 of this code. (Ord. 278N § 15(part),
2004).
17.70.030 Financial responsibility.
Payment for the services of the county surveyor, and any charges required
for processing the official map by the county surveyor, shall be the
responsibility of the applicant. (Ord. 278N § 15(part), 2004).
17.70.040 Surveyor certification.
The official map shall include a surveyor certificate stating that the map
was prepared pursuant to the provisions of Government Code 66499.52 and shall
include an approval certificate of the county surveyor. The certificate shall
be signed, and below or immediately adjacent to the signature, shall indicate
the license or registration number with expiration date of the registered civil
engineer or license land surveyor preparing and approving the official map.
(Ord. 278N § 15(part), 2004).
17.70.050 Compilation of official map or resurvey.
The engineer or surveyor under the direction and with the approval of the
board of supervisors may compile the map from maps on file, or may resurvey or
renumber the blocks, or renumber or reletter the lots in the blocks, or change
the names of the streets. (Ord. 278N § 15(part), 2004).
17.70.060 County certification.
Each and every map made and adopted pursuant to the provisions of this
chapter shall be certified under the hands of a majority of the members and the
presiding officer and secretary and official seal of the board of supervisors.
The certificate shall set forth in full the resolution adopting the map, with a
date of adoption. (Ord. 278N § 15(part), 2004).
17.70.070 Recordation of official maps.
The map, so certified, shall be forthwith filed in the office of the
county recorder. The recorder shall immediately securely fasten and bind each
map so filed in one of a series of firmly bound books to be provided, together
with the proper indices thereof and appropriately marked for the reception of
the maps provided for in the division of the Government Code governing official
maps. (Ord. 278N § 15(part), 2004).
17.70.080 Maps official after certification.
The maps shall become an official map for all purposes when certified,
filed and bound, and not before. (Ord. 278N § 15(part), 2004).
17.70.090 References to official maps as sufficient identification.
Whenever the board of supervisors adopts a map as provided in this chapter
as the official map of a subdivision, town or county, it shall be lawful and
sufficient to describe the lots or blocks in any deeds, conveyances, contracts,
or obligations affecting any of the lots or blocks as designated on the official
map, a reference sufficient for the identification of the map being coupled with
the description. (Ord. 278N § 15(part), 2004).
17.70.100 Surveys and field notes as public records.
All surveys and the field notes thereof made by any engineer or surveyor,
under the provisions of this chapter, or in surveying officially any lots or
parcels of land in any town or county for the purposes of any map under this
chapter, shall be filed in the office of the surveyor or engineer, as the case
may be, and shall become a part of the public records of the county. (Ord. 278N
§ 15(part), 2004).
