The division of the Madera County department of health presently referred to as the department of environmental health, hereby
transferred out of the department of health and established as a separate and independent department, is to be known as the
department of environmental health.
A. It is the specific intention and desire of the board of supervisors that the services and programs of the department of environmental
health be maintained at levels of quality and efficiency equal to or higher than the level of the services and programs formerly
provided by the department of health. To this end, the board of supervisors specifically directs that the department of health
and the department of environmental health maintain open lines of communication in order to insure coordination of public
health and environmental health services and programs.
B. All references in this chapter to department are to the department of environmental health unless otherwise indicated.

2.28.020 - Purpose.
The purpose of the department is to provide all necessary services in the area of environmental health and sanitation including,
but not limited to, the following:
A. Supervision, inspection and regulation of food and water supplies;
B. Supervision, inspection and regulation of wastewater disposal and reclamation, solid waste, air pollution and land use;
C. Supervision, inspection and regulation of land and water recreational activities and safety;
D. Such additional services and programs as may be authorized from time to time by the board of supervisors.

2.28.040 - Administration.
The administration of the department shall be by a director who shall possess the following minimum qualifications:
A. A valid California certificate of registration as a registered environmental health specialist;
B. Seven years' experience in environmental health with at least three years' experience in a management or administrative capacity;
C. A bachelor's degree, or the equivalent, with major coursework in environmental health, biology, chemistry, or a related field.

2.28.050 - Personnel.
A. In addition to the director, the staff of the department shall consist of such additional registered environmental health
specialists, environmental health specialists, support personnel, and clerical employees as is necessary to adequately perform
the services to be performed by the department.
B. All registered environmental health specialists employed by the department shall possess a valid California certificate of
registration at the time they are employed.
C. There shall be one clerical employee with sufficient qualifications and ability to supervise the clerical staff and manage
the routine affairs of the office.
D. All appointments to the position of environmental health specialist shall be for a minimum of three years or until obtaining
a valid California certificate of registration as a registered environmental health specialist, whichever occurs first.

2.28.060 - Laboratory services.
All necessary microbiology laboratory services shall be provided to the department by the department of public health laboratory.

2.28.070 - Emergency duties.
Nothing herein contained shall be deemed to limit or otherwise restrict the authority of the county health officer during
a state of emergency. The county health officer shall also retain all authority necessary to comply with all provisions of
law to be complied with by him.
