Chapter 2.92 - ALTERNATIVE PROCEDURE FOR LEASING OF COUNTY-OWNED REAL PROPERTY

2.92.010 - Alternative procedure for leasing of county-owned real property.

A.   Pursuant to the authority of Government Code Section 25537, as an alternative to the procedures required by Government Code Sections 25526 through 25535 for the leasing of any real property belonging to the county, the procedures contained in this chapter may be utilized whenever the board of supervisors determines it is for the best interest of the county.
B.   The alternative procedure for the leasing of any real property belonging to the county shall be as follows:
1.   The board of supervisors shall approve a call for bids, specifying the nature and location of the real property to be leased, the minimum bid price, the length of the lease term, any restrictions on use of the property, any other conditions or restrictions deemed appropriate, and the closing date for the submission of bids.
2.   The call for bids must be posted in at least three public places, including the county government centers in Madera and Bass Lake, for at least fifteen days prior to the closing date for the submission of bids. In addition, the call for bids must be published for not less than two weeks in a newspaper of general circulation within the county.
3.   Sealed bids shall be submitted to the county purchasing agent by the time and date specified in the call for bids. The purchasing agent shall open and examine the bids at that time and report to the board of supervisors on the bids within two weeks thereafter. The board of supervisors shall either accept the highest bid which meets the minimum terms, conditions and restrictions established in the call for bids or it shall reject all the bids.

2.92.020 - Leases excluded from bidding procedures.

A.   Pursuant to Government Code Section 25537(b), the board of supervisors may exclude from the bidding procedures required by Government Code Sections 25526 through 25535 and from the alternative procedures for the leasing of county-owned real property prescribed by this chapter those leases of a duration not exceeding five years and having a monthly rental not exceeding two thousand dollars per month if the procedures specified in subsection B of this section are followed.
B.   Leases of a duration not exceeding five years and having a monthly rental not exceeding two thousand dollars per month may be excluded from the bidding procedures otherwise required by state law or this chapter if a notice describing the property proposed to be leased, the terms of the lease, the location where leases will be executed, and the name of any county officer authorized to execute the lease is posted in the office of the county clerk and is published in advance of at least one time in a newspaper of general circulation within the county of Madera. The actual monthly rental for leases so excluded shall not exceed two thousand dollars per month, the term of the executed leases shall not exceed five years, and the leases are not renewable. Any such leases must be approved and their execution authorized by the board of supervisors at a regular or special meeting.
