ADOPTION--GENERAL PROVISIONS

14.04.010
Purpose. This article is adopted pursuant to Sections
50022.1 through 50022.4 of the California Government Code
to provide minimum standards to safeguard life or limb, health,
property, and public welfare, by regulating and controlling
structural design, construction, materials, occupancy, and
location of all buildings and structures within the unincorporated
area of the county. (Ord. 367 §1, 1972). top
14.04.020Application.
This article shall apply to the erection, construction,
enlargement, alteration, repair, relocation, conversion, occupancy
and maintenance of buildings, structures, swimming pools,
the installation of electrical wiring and appliances, the
plumbing, heating and cooling facilities and appurtenances
necessary thereto within the unincorporated area of the county.

14.04.025Application
to roadside stands. No person shall operate a roadside
stand for the sale of food or merchandise from a motor vehicle,
trailer, tent or other facility, except a structure ' which
complies with the provisions of this article. This article
applies to such roadside stands regardless of their size or
cost of construction. This article shall not apply to roadside
stands operated by a person selling agricultural, viticultural
or horticultural products, or the products of any stock, dairy
or poultry farm, grown and produced by his own labor on real
property located in the county, owned, leased or possessed

14.04.030Uniform
codes. The following codes are incorporated by reference
and, except as otherwise provided herein, are applicable to
and shall govern standards for buildings and construction
within their respective applications:
A. The Uniform Building Code, 1994 Edition, including the
appendices (except appendix, Chapter 4, Division 1), as adopted
by the International Conference of Building Officials. Minimum
plumbing fixtures for nonresidential construction shall comply
with Table A-29-A "Minimum Plumbing Fixtures" of
the Uniform Building Code;
B. The Uniform Mechanical Code, 1994 Edition, including all
appendices thereto, adopted by the International Conference
of Building Officials;
C. The Uniform Housing Code, 1994 Edition, including all appendices
thereto, as adopted by the International Conference of Building
Officials;
D. The Uniform Plumbing Code, 1994 Edition, including all
appendices thereto, as adopted by the International Association
of Plumbing and Mechanical Officials;
E. The National Electric Code, 1996 Edition, including all
appendices thereto, as adopted by the National Fire Protection
Association;
F. The Uniform Code for the Abatement of Dangerous Buildings,
1994 Edition, including all appendices thereto, as adopted
by the International Conference of Building officials;
G. The Uniform Solar Energy Code, 1994 Edition, including
all appendices thereto, as adopted by the International Association
of Plumbing and Mechanical Officials;
H. The Uniform Fire Code, 1994 Edition, including all appendices
thereto, jointly adopted by the International Conference of
Building Official and the Western Fire Chiefs Association;
I. National Fire Codes, current edition, as adopted by the
National Fire Protection Association;
J. Uniform Swimming Pool, Spa, and Hot Tub Code, 1994 Edition,
as adopted by the International Association of Plumbing and

14.04.035Exemption
of agricultural storage buildings from portions of Uniform
Fire Code. The provisions of Division IV, water supplies
for fire protection, of the Uniform Fire Code shall not be
applicable to buildings used primarily for the storage of
farm equipment and supplies. (Ord. 367-N §1, 1994). top
14.04.036Water
storage requirements for single-family residences in areas
without water serving utilities. Single-family residences
in areas of the county without water serving utilities shall
be deemed to meet the requirements of Division IV, water supplies
for fire protection, of the Uniform Fire Code so long as an
insurance services office rating of "Rural 8" or
better is maintained. (Ord. 367-N §2, 1994). top
14.04.040Filed
code copies. The copies of the codes adopted under
Section 14.04.030 shall be kept on file in the office of the
building official for the use and convenience of the public
during regular office hours. (Ord. 367 §90, 1972). top
14.04.050
Qualification of workmen. Workmen shall be licensed
and insured as required by state law and county ordinances.
No additional examination or certifications of workmen shall
be required by the provisions of this article. (Ord. 367 §81,
1972). top
14.04.060Definitions.
Whenever the following terms appear in this article or in
any of the codes referred to in Section 14.04.030, they shall
have the meanings ascribed to them in this section:
"Administrative authority" means the county engineer,
except that when used in the Uniform Code for the Abatement
of Dangerous Buildings, "administrative authority"
means the Madera County environmental health office or its
authorized assistants, deputies or inspectors.
"Building department" means the department of engineering
and general services, division of building and safety.
"Building official" means the county engineer or
his authorized assistants, officers or inspectors, except
that when used in the Uniform Code for the Abatement of Dangerous
Buildings, "building official" means the environmental
health office or its authorized assistants, deputies or inspectors.
"City" means the unincorporated area of the county
of Madera.
"City attorney" means the county counsel.
"City council" means the board of supervisors.
"Construction" includes erection, enlargement, alteration,
conversion and relocation, including replacement of roofing
and siding.
"Mayor" means the chairman of the board of supervisors.
"Municipality" means the county of Madera.
