14.36.010 Adopted.
There is hereby adopted by the county for the purpose of
prescribing regulations governing conditions hazardous to
life and property from fire or explosion, that certain code
known as the Fire Prevention Code recommended by the American
Insurance Association, being particularly the 1965 edition
thereof and the whole thereof, with amendments, save and
except such portions as are deleted, modified or amended
in this chapter, of which code not less than three copies
are filed in the office of the clerk of the board of supervisors,
and the same are hereby adopted and incorporated as fully
as if set out as length herein, and from the date on which
the ordinance codified herein takes effect, the provision
thereof shall be controlling within the limits of the county.

14.36.020 Fire Prevention Code--Definitions.
A. Wherever the word "Corporation
Counsel" is used in the Fire Prevention Code, it means the
county counsel of the county of Madera.
B. Wherever the word "Municipality"
is used in the Fire Prevention Code, it means the county
of Madera. (Ord. 328 §3, 1968). top

14.36.040 Appeals. Whenever
the county engineer disapproves an application or refuses
to grant a permit applied for, or when it is claimed that
the provisions of the code do not apply or that the true
intent and meaning of the code have been misconstrued or
wrongly interpreted, the applicant may appeal from the decision
of the county engineer to the board of supervisors within
thirty days from the date of the decision appealed.

14.36.050 Establishment and duties
of bureau of fire prevention. A.
The Fire Prevention Code shall be enforced by the bureau
of fire prevention in the office of the county engineer.
The bureau of fire prevention is hereby established
and shall be operated under the supervision of the county
engineer.
B. The county engineer may detail
such members of the staff as inspectors as shall from time
to time be necessary. The county engineer shall
recommend to the board of supervisors the employment of
technical inspectors, who, when such authorization is made,
shall be selected through an examination to determine their
fitness for the position. The examination shall
be open to members and nonmembers of the county engineer's
staff.
C. A report of the bureau of fire
prevention shall be made annually and transmitted to the
board of supervisors. It shall contain all
proceedings under this code, with such statistics as the
county engineer may wish to include therein.
The county engineer shall also recommend any amendments
to the code which in his judgement, shall be desirable.

14.36.060 New materials, processes
or occupancies which may require permits.
The county engineer shall determine and specify, after giving
affected persons an opportunity to be heard, any new materials,
processes or occupancies, which shall require permits, in
addition to those now enumerated in said code.
The county engineer shall post such list in a conspicuous
place in his office, and distribute copies thereof to interested

14.36.070 Penalties.
A. Any person who violates any of the provisions
of this chapter is guilty of a misdemeanor.
Any person who violates of fails to comply with any order
of the county engineer pursuant to this chapter is guilty
of a misdemeanor. Any person who builds in
violation of any detailed plans and specifications, pursuant
to the provisions of this chapter, or order of the county
engineer, is guilty of a misdemeanor. Any person
who violates the provisions of any certificate or permit
issued pursuant to this chapter is guilty of a misdemeanor.
Any person who violates an order issued by
the board of supervisors, or by a court of competent jurisdiction,
within the time fixed by this chapter, shall severally for
each and every such violation and non-compliance, respectively,
be guilty of a misdemeanor punishable as provided by Chapter
1.12 of this code. The imposition of one penalty
for any violation shall not excuse the violation or permit
it to continue, and all such persons shall be required to
correct or remedy such violations or defects within a reasonable
time, and when not otherwise specified, each ten days that
prohibitive conditions are maintained constitutes a separate
offense.
B. The application of the above
penalty shall not be deemed to bar any legal, equitable
or summary remedy to which the county of Madera, any other
political subdivision, or any person may be otherwise entitled.
