MINUTES

SPECIAL MEETING
WEDNESDAY, NOVEMBER 4, 2009
1:00 P.M.
MADERA COUNTY GOVERNMENT CENTER
BOARD OF SUPERVISORS’ CHAMBERS

PRESENT:
Commissioners: Tom Fry (president), David Linn, and Nancy Meyers

County Representatives: Lonn Boyer, Director of Human Resources; Adrienne Calip, Asst Director of Human Resources; and Susan Carter, Senior Personnel Analyst

Absent: Commissioners David Dutton and Alfred Rodriguez

1. Public Comment. There was no public comment.

2. Consent Calendar. On motion by Commissioner Linn, seconded by Commissioner Meyers, it was ordered:

“That the consent calendar be approved.”

3. Continuation of Scheduling conference for hearing on Appeal of Order of Disciplinary Action, Certified Alcohol and Drug Counselor, Department of Behavioral Health Services. Neither the appellant or the appellant’s representative, Jun Payoyo, attended the Commission meeting. David Prentice, Madera’s County Counsel, stated that while Mr. Payoyo, the appellant’s representative, has not returned any telephone messages and hasn’t contacted his office to meet and confer, he believes that the appeal hearing can be completed at one meeting. Due to previously scheduled appeal and grievance hearings, Mr. Prentice requested that the Commission set this appeal hearing for the Commission’s regular meeting date in February. On motion by Commissioner Linn, seconded by Commissioner Meyers, it was ordered:

“That the hearing on Appeal of Order of Disciplinary Action, Certified Alcohol and Drug Counselor, Department of Behavioral Health Services, be scheduled for February 10, 2009. Regular business to begin at 5:30 p.m., with the hearing to immediately follow.”

4. Consideration of leave of absence request, Jeanette Brady, Licensed Mental Health Clinician, Department of Behavioral Health Services, from October 13, 2009 through January 13, 2010. On motion by Commissioner Meyers, seconded by Commissioner Linn, it was ordered that:

“The leave of absence request, Jeanette Brady, Licensed Mental Health Clinician, Department of Behavioral Health Services, from October 13, 2009 through January 13, 2010, be approved.”

5. Consideration of leave of absence request, Dana Elliott, Deputy Probation Officer III, Probation Department, from November 7, 2009 through December 7, 2009. County Probation Officer, Rick Dupree, spoke in support of the leave of absence request. On motion by Commissioner Linn, seconded by Commissioner Meyers, it was ordered that:

“The leave of absence request, Dana Elliott, Deputy Probation Officer III, Probation Department, from November 7, 2009 through December 7, 2009, be approved.”

6. Consideration of leave of absence request, Janie Solis, Eligibility Worker II, Department of Social Services, from October 5, 2009 through December 31, 2009. Terry Hurt, Administrative Analyst, spoke on behalf of the Department of Social Services. On motion by Commissioner Meyers, seconded by Commissioner Linn, it was ordered that:

“That the leave of absence request, Janie Solis, Eligibility Worker II, Department of Social Services, from October 5, 2009 through December 31, 2009, be denied.”

7. Consideration of leave of absence request, Esther Cuevas, Eligibility Worker II, Department of Social Services, from October 2, 2009 through December 1, 2009. On motion by Commissioner Meyers, seconded by Commissioner Linn, it was ordered that:

“That the leave of absence request, Esther Cuevas, Eligibility Worker II, Department of Social Services, from October 2, 2009 through December 1, 2009, be denied.”

8. Consideration of leave of absence request, Joyce Greco, Eligibility Worker II, Department of Social Services, from October 19, 2009 through November 30, 2009. Ms. Greco spoke in support of her leave of absence request. Terry Hurt, Administrative Analyst, spoke on behalf of the Department of Social Services. An initial motion to disapprove the leave of absence request was made by Commissioner Meyers; but died for lack of a second. On motion by Commissioner Linn, seconded by Commissioner Meyers, it was ordered that:

“The leave of absence request, Joyce Greco, Eligibility Worker II, Department of Social Services, from October 19, 2009 through November 30, 2009, be approved.”

9. Consideration of request to adopt the amended class specifications for Correctional Officer I/II. Commissioner Linn objected to the amended language which required that incumbents maintain a valid driver’s license as a condition of continued employment, and requested that Chief Papagni report to the Commission during the December meeting to provide suggestions for alternative language. On motion by Commissioner Linn, seconded by Commissioner Meyers, it was ordered that:

“This item be tabled to the December 2009 Business meeting, and request that Chief Papagni be present to provide alternative language.”

10. Consideration of request for early expiration of the Health Education Coordinator eligible list. Van Do-Reynoso, Assistant Director of Public Health, spoke in support of the request and advised the Commission that an upcoming position will perform duties to address teen pregnancy in Madera County. On motion by Commissioner Meyers, seconded by Commissioner Linn, it was ordered that:

“That the request for early expiration of the Health Education Coordinator eligible list, be approved.”

11. Staff Reports. Lonn Boyer, Director of Human Resources, asked the Commissioners how they wish to proceed in the review and amendment of the County Code. The Commission requested that an action item be placed on the December 9, 2009 agenda, and for the Department of Human Resources to provide the Commission with drafts of proposed language amendments.

12. Adjournment. On motion by Commissioner Linn, seconded by Commissioner Meyers, it was ordered:

“That the meeting be adjourned.”
