REQUEST FOR COMMENTS FROM THE AUDIENCE
This portion of the meeting is set aside for members of the public to comment on any item within the jurisdiction of the Commission, but not appearing on the agenda. Items presented under public comment may not be discussed or acted upon by the Commission at this time. For items appearing on the agenda, the public is invited to comment at the time the item is called for consideration by the Commission. Any person addressing the Commission under public comment will be limited to a 3 minute presentation to insure that all interested parties have an opportunity to speak. Also, all persons addressing the Commission must state their name and address for the record. ALL MATTERS LISTED UNDER CONSENT CALENDAR ARE CONSIDERED TO BE ROUTINE AND WILL BE ENACTED BY ONE MOTION.

PLANNING COMMISSION PUBLIC HEARINGS:
1. DAVIS SURVEYS – REZONE (CZ #2009-007) – OAKHURST (DISTRICT #5)
Davis Surveys is requesting a Rezoning (CZ #2009-007) to allow a 12 unit apartment complex. The application is proposing to rezone 4.75 acres of the parcel to RUM (Residential, Urban, Multiple Family). The property is owned by Schneider, Nancy A.; Schneider, Roger A.; Wilkins, Eric; Wilkins, Kristie; & Allison, Steve; and is located on the east side of Redbud Drive, approximately 0.5 mile southeast of its intersection with Highway 49, Oakhurst. The property is zoned RMS (Residential, Mountain, Single Family) District. The proposed zone is RUM (Residential, Urban, Multiple Family) District. This project is located in the Oakhurst Area Plan. A Mitigated Negative Declaration (MND #2009-16) has been prepared for the project in compliance with provisions of the California Environmental Quality Act (CEQA). Size: 4.75 acres. APN: 064-150-022.
2. AG PRESERVES - REZONE
This hearing is to consider the rezoning of lands currently proposed for inclusion in the Agricultural Preserve Program for 2010 (contracts with Madera County under the provisions of the Williamson Act) to ARE-40 (Agricultural, Rural, Exclusive-40 Acre) District from ARE-20 (Agricultural, Rural, Exclusive-20 Acre), ARE-40 (Agricultural, Rural, Exclusive-40), ARF (Agricultural, Rural, Foothills), ARV-20 (Agricultural, Rural, Valley-20), & -RM (-Residential, Mountain) Districts.
*3. CHARLES J. ROESBERY JR. – PARCEL MAP (PM #4140) - RAYMOND (DISTRICT #1)
Charles J. Roesbery, Jr. is requesting a Parcel Map (PM #4140), which would divide a 159.26 acre property into 4 parcels (37.03 acres, 41.75 acres, 38.00 acres, & 36.87 acres). The property is located on the north and south sides of Road 600, approximately 650 feet southwest of its intersection with Road 612 (no situs), Raymond. The property is zoned ARF (Agricultural, Rural, Foothills) District. A Mitigated Negative Declaration (MND #2009-013) has been prepared for the project in compliance with provisions of the California Environmental Quality Act (CEQA) and is available together with the Initial Study for public review at the Madera County Planning Department. Size: 159.26 acres. APN: 053-080-007.
*4. MADERA POWER LLC – CONDITIONAL USE PERMIT (CUP #2009-012) - FIREBAUGH (DISTRICT #1)
Madera Power, LLC is requesting a conditional use permit (CUP #2009-012) to allow composting of organic materials. The property is owned by Madera Power LLC and is located on the north side of the intersection of Firebaugh Boulevard, Avenue 7½, and Avenue 7 (11427 Firebaugh Boulevard), Firebaugh. The property is zoned ARE-20 (Agricultural, Rural, Exclusive-20 Acre) District. A draft Mitigated Negative Declaration (MND #2009-14) has been prepared concerning the proposed project in compliance with provisions of the California Environmental Quality Act (CEQA). Size: 172.2 acres. APN: 042-081-001.
*5. GILL RANCH STORAGE LLC – CONDITIONAL USE PERMIT (CUP #2009-015) – MADERA (DISTRICT #1)
Gill Ranch Storage LLC is requesting a Conditional Use Permit (CUP #2009-015) to allow an office building, associated parking, waste disposal, landscaping and driveway improvements accessory to an underground natural gas storage project. Please review the California Public Utility Commissions Mitigated Negative Declaration at http://www.cpuc.ca.gov/Environment/info/mha/gillranch/dismnd.htm. The property is owned by Rupe, Opal J. Testamentary Trust; Buchanan, Teresa D.; Rupe, C. D.; Sullivan, Betty; Sullivan, Larry; Rusconi, Susan; Hoffman, Tammy; Weston, Tanya; Imamura, Sheryl; and Buchanan, Teresa; and is located on the southeast corner of the intersection at Road 16 and Avenue 3 alignments, (no situs available) Madera. The property is zoned ARE-40 (Agricultural, Rural, Exclusive-40 Acre) District. Size: 342.75 acres. APN: 040-213-006.
6. MADERA COUNTY – REZONE (CZ #2009-004) – COUNTY WIDE Madera County Planning is requesting a Zoning Ordinance Text Change (CZ #2009-004) to amend Title 17, Chapter 17.74, Lot Line Adjustment ordinance to comply with State law.
7. MADERA COUNTY – REZONE (CZ #2009-008) – COUNTY WIDE
Madera County Planning is requesting a Zoning Ordinance Text Change (CZ #2009-008) to allow for commercial solar farms. No action to be taken. THIS ITEM WILL BE FOR PUBLIC COMMENTS ONLY. NO ACTION WILL BE TAKEN BY THE PLANNING COMMISSION.
8. MADERA COUNTY – GENERAL PLAN AMENDMENT (GP #2009-005) – COUNTY WIDE
Madera County Planning Department is requesting an amendment to the Madera County General Plan (GP #2009-005) pursuant to Section 65358 of the Government Code. The proposal is to amend the 1995 General Plan and adopt the updated noise vibration level to be in compliance with the latest California Department of Transportation Earthborne Vibration study completed on February 20, 2002.

PLANNING COMMISSION MEETING PROCEDURES Planning Commission meetings are conducted under the direction of the Chairman. Each item scheduled for public hearing at a Planning Commission meeting will be announced by the Chairman, and the hearing will be conducted as follows:
1. The Planning staff will present their report and recommendation on the matter being heard. Commission members will be provided an opportunity to question staff.
2. The Chairman will first ask the project applicant or proponent to present any points they feel the Commission should understand about their proposal. The Commission may ask questions.
3. The Chairman will ask those in support and then those opposed to the application to come to the podium and present any testimony they wish to give in regard to the proposal being considered.
4. The Chairman will offer the project applicant an opportunity for rebuttal of any testimony against the proposal or to clarify information previously presented.
5. The public comment portion of the hearing will be closed and the matter will be deliberated by the Commission and a decision will be rendered.
RULES FOR PRESENTING TESTIMONY
All persons who wish to present testimony to the Planning Commission in a public hearing must observe the following rules:
1. All testimony must be presented from the podium. When beginning to speak, first identify yourself, place of residence, and interest in the matter. This is required for the public record. Since all meetings are tape recorded, please speak clearly and use the microphone provided.
2. All remarks must be addressed to the Chair. Conversation or debate between a speaker at the podium and a member of the audience or staff is not permitted.
3. Please keep your remarks as brief as possible. Focus your testimony on the most important facts you wish to be considered. Avoid duplicating testimony provided by others.
4. Planning Commission hearings can involve highly emotional issues, so it is important that all participants conduct themselves with courtesy, dignity, and respect.
5. Whenever possible, written testimony should be presented as well as oral. Written testimony should be submitted for Planning Commission consideration in advance of the actual hearing date.
